Legal Cannabis in Nevada

Recreational cannabis has not always been legal in the state of Nevada. However, this state is well known for its lax approach to a wide variety of things such as gambling, guns, and prostitution, so it was only a matter of time before cannabis consumption became legal as well.

In 1998, Nevada voters approved cannabis for medical use, and it was available for that purpose as of 2001.

At that time, wheels were in motion towards future recreational use, as well. Also, in 2001, Assembly Bill 453, which legalized medical cannabis, reduced the penalty for possession for non-medical users. Before this time, Nevada was the only state in the country that considered possession of any amount of cannabis as a felony offense.

First and second offenses of possession became small misdemeanors, which was a significant relief for so many, and which helped free up law enforcement funds and energy for other, more important purposes.

After failed movements to decriminalize cannabis for recreational use in 2002 and 2006, the 2016 Initiative to Regulate and Tax Marijuana was put to a citizen vote. It passed, although there was some pushback from casino owners.  On July 1, 2017, recreational sales of cannabis in Nevada began.

The availability of recreational cannabis in Nevada, then, is relatively new. Still, already thousands of visitors and residents have taken advantage of it and have enjoyed legal marijuana in The Silver State.

Purchasing Cannabis in Nevada

If you wish to buy recreational cannabis in Nevada, now you can! To make a purchase, you must be over the age of 21 and have identification to prove it. Your ID must not be expired, and the staff at the dispensary must be able to scan it to confirm that it is valid.

The cannabis you will purchase this way will be recreational grade. Medical grade cannabis is a bit stronger and is not subject to the 10% tax you will pay when buying recreational marijuana. Medical users can also purchase larger quantities of products.

If you possess a medical card from another state, you can use it in Nevada. This state offers reciprocity with all other states that issue medical cannabis cards.

Possessing Cannabis in Nevada

As a recreational user, you can purchase up to an ounce of flower or an eighth of an ounce of concentrates like shatter, wax, crumble, or oil. When traveling around Nevada, you can have up to an ounce of product in your possession at any time.

However, if you plan to leave the state, you absolutely cannot take your cannabis with you – even if you are traveling to another state where it is legal. It is illegal to bring cannabis across state lines, regardless of how you are getting there. Nevada borders both California and Oregon, and both of those states also have recreational cannabis, but you will have to finish your Nevada purchases before entering either one.

Consuming Cannabis in Nevada

Once you purchase recreational cannabis in Las Vegas, however, you may soon realize you have a problem. All cannabis consumption in the state must occur on private property. You cannot smoke on the street, you cannot smoke in a casino, and you cannot smoke in your hotel room.

If you don’t know someone who lives in Las Vegas, you may not have anywhere to smoke legally. This is why many visitors to Nevada choose smoke-free delivery methods such as vapes or edibles.

In October 2019, the first cannabis consumption lounge in the state opened. It exists on sovereign land owned by the Las Vegas Paiute Tribe and is subject to different laws than the rest of the city. Many local users and businesses hope that soon, visitors will have more legal places to consume cannabis as well.
